Privacy Policy

Wine Collective Holdings Pty Ltd (ABN 45 003 409 603) and its related entities (‘The Wine Collective’) are bound by the Privacy Act 1988 (Cth), and the Australian Privacy Principles (‘APPs’) as set out in Schedule 1 of the Act. The Wine Collective takes reasonable steps to protect personal information collected from misuse, loss, unauthorised access, modifications or disclosure.

The purpose of this policy is to clearly state how we intend to meet our obligations under the APPs in relation to the personal data we collect from all our customers from around the world, and in addition to the extent applicable, the European Union (EU) General Data Protection Regulation (‘GDPR’), where we process personal data relating to identifiable individuals to whom the GDPR applies, and the Data Protection Act 2018 (UK) (‘UK Act’), where we process personal information relating to UK residents.

This policy sets out how The Wine Collective collects, holds, uses and discloses your personal information, how you can access your personal information, how to complain about any breach of the APPs, and whether or not we disclose personal information outside of Australia. 

By accessing or using The Wine Collective’s services, including its website located at www.thewinecollective.com.au, you agree to the use and disclosure of your personal information in the manner described in this policy. The policy is continuously reviewed and may change over time. Amendments to the policy will be published on this website.

In this policy, ‘personal information’ refers to information or an opinion, whether true or not and whether recorded in a material form or not, about a natural person whose identity is apparent, or can reasonably be ascertained, from the information or opinion.


What personal information is collected?

The Wine Collective collects personal information that it considers necessary to provide the range of services it offers.


Personal information collected by The Wine Collective may include:

  • Your name;

  • Your address and contact details;

  • Your bank account and credit account details;

  • The user ID and password you use to log onto The Wine Collective’s website;

  • Details of the services The Wine Collective has provided to you; and

  • A record of your communications with The Wine Collective, including agreements, forms, electronic requests and enquiries, bulletin boards, live chat, blogs, competition entries, online forums, phone calls and other forms of electronic messaging.

 

How is personal information collected?

The Wine Collective collects personal information in a number of ways, including:

  • Directly from you when you provide information to The Wine Collective in person, by phone or in writing (whether electronic or otherwise);

  • Directly from you when you communicate with The Wine Collective or a person representing The Wine Collective; and

  • Indirectly from third parties where you have provided consent to those parties to share your personal information with us, such as:

    • Resellers of The Wine Collective's services; 

    • Service providers used by The Wine Collective; or

    • Operators of linked websites or applications promoted on The Wine Collective’s website.



 How is personal information used?

Your personal Information may be used for the following purposes:


  • To provide the services requested by you, including enabling your Personal Wine Advisor to recommend wines that you are likely to enjoy based on our record of wines you have previously purchased and enjoyed;

  • To manage the provision of those services, including providing customer support, invoicing and receipting services;

  • To obtain feedback in relation to your usage of and satisfaction with The Wine Collective's services so they can be enhanced;

  • For purposes connected with the operation of The Wine Collective’s website and to generate statistics in relation to the website;

  • To personalise advertising displayed on The Wine Collective’s website; and

  • To notify you of special offers and promotions. 


If you do not wish to be notified of special offers and promotions, please click the ‘contact us’ link at the bottom of this page to advise that you would like to opt out of these notifications. 

All emails and SMS messages from The Wine Collective include a link or STOP function to enable you to opt out of receiving further emails and / or SMSs.


How is personal information disclosed?

The Wine Collective may disclose your personal information to other parties, including:


  • Government and regulatory authorities as required by law;

  • Outsourced service providers who assist The Wine Collective in providing its services (but only to the extent needed to perform their functions, and no other purposes), including:

    • Information technology providers;

    • Marketing and market research advisers; and

    • Professional advisers;

  • Organisations involved in the sale / transfer of The Wine Collective’s assets, business or shares;

  • Resellers of The Wine Collective’s services;

  • The public if you advertise with The Wine Collective; and

  • Parties that advertise with The Wine Collective if you submit an enquiry to The Wine Collective. These parties may include:

    • Private advertisers; and

    • Operators of linked websites or applications promoted on The Wine Collective’s website. 


If your personal information is shared to a third party advertiser, it will be subject to any applicable privacy policy of that advertiser. If you do not want The Wine Collective to disclose your personal information to advertisers, please submit enquiries in relation to their services directly to the advertiser, not to The Wine Collective.




How to access your personal information

If you wish to access your personal information, please submit a request for the information you require, providing as much detail as possible. There is no charge for this service. 


UK + EU residents also have the following additional rights: 

• the right to be informed about how their personal information is being used; 

• the right to request that we erase their personal information (right to be forgotten); 

• the right to obtain a copy of their personal information on request;

• the right to have incorrect personal information updated; 

• the right to transfer their personal information to another person or entity (right of data portability);

• the right to restrict or object to processing, or withdraw consent to processing; and 

• the right to lodge a complaint with a supervisory authority (see below).    


You can choose not to provide your personal information

If you choose not to provide personal information when requested, The Wine Collective may not be able to provide you with the full range of its services.


Personal information provided via websites

The Wine Collective’s website may include links to third party websites and applications. When you visit a linked third party website or application via The Wine Collective’s website, The Wine Collective records anonymous information such as IP address, time, date, referring URL, pages accessed, documents downloaded, type of browser and operating system used. 

The Wine Collective’s website uses ‘cookies’ to provide you with the full range of services offered by The Wine Collective, remember your preferences, remember the sites you visit on the website, measure and analyse website usage and for security. A cookie is a small file that remains on your computer until you turn your computer off or it expires (typically after 30 to 90 days). Cookies may collect and store your personal information. Persistent cookies may be used to identify the sites you visit on The Wine Collective’s website and personalise the advertising you see when you make future visits to the website. The Wine Collective’s website uses Google Analytics, a web analytics service provided by Google, Inc.

You can adjust your Internet browser to disable cookies. If cookies are disabled, The Wine Collective may not be able to provide you with the full range of its services.

Companies who operate linked websites may also collect, hold, use and disclose personal information via cookies and otherwise. The Wine Collective does not control and is not responsible for personal information collected by linked websites and recommends you read these websites’ privacy policies and terms and conditions before disclosing your personal information.


How to request the deletion of your personal information

To request the deletion of any or all of your personal information held by The Wine Collective, please click the ‘contact us’ link at the bottom of this page and submit a request.

 

How to withdraw consent to receive marketing communications

To withdraw your consent to receive marketing communications, please email your request to customers@thewinecollective.com.au.

If you just want to withdraw your consent to receive marketing communications via email, you can do so by clicking on the ‘Unsubscribe’ link in the email. 

If you want to withdraw your consent to receive marketing communications via SMS, you can do so by replying ‘STOP’ to an SMS.

It may take up to five (5) business days for your request to be actioned, so you may still receive marketing communications during this period. 

If you withdraw your consent to receive marketing communications through just one mode of communication (e.g. SMS) you will continue to receive marketing communications via other communication modes (e.g. email). 

Please note that it is not possible to unsubscribe from non-promotional (transactional) communications relating to your online orders or the operation of your account. 


Overseas Disclosure

We may disclose your personal information to third parties outside of Australia in the course of providing our services. These third parties are for example a technology service provider. When we do so, we take reasonable steps to ensure that any overseas third party will handle your personal information in a way that is consistent with the Australian Privacy Principles.


Complaints

If you wish to complain about a concern regarding the handling of your personal information, you can direct your complaint to us via our ‘Contact Us’ page. We will endeavour to respond to any complaints as soon as they are received.

If we are unable to satisfactorily resolve your concerns or complaint, you can contact the Office of the Australian Information Commissioner at www.oaic.gov.au. UK & EU residents can contact the local regulator in their jurisdiction in the UK or Europe, as applicable.
